For many families, the primary goal of creating a living revocable trust is probate avoidance. Anyone with a home should consider establishing a living trust because that is an asset that generally has to pass through probate proceedings, which is costly and a long process.
Probate
Probate is a court supervised proceeding. Anytime someone passes intestate (without a will or a trust), the estate has to go through probate. During this long process, your loved ones must rely on the court to assign persons to assess the value of the estate and determine to whom they should distribute.
